Platform Disclaimer & Limitation of Liability

1. We are a listing platform only.

Mobile Service USA ("we," "us," "the Platform"), operated by [YOUR COMPANY NAME, LLC], is an online directory where independent service providers advertise their businesses. We are not a contractor, employer, agent, broker, insurer, or referral guarantor of any provider. We do not perform, supervise, direct, or control any services. Providers are independent businesses, not our employees or agents.

2. No verification, endorsement, or guarantee.

We do not screen, vet, license-check, insure, bond, or background-check providers, and we do not endorse or recommend any provider. Listings, badges, ratings, reviews, and "Featured" or "Pro Member" labels reflect information supplied by providers or users, or paid placement, and are not statements or guarantees of quality, safety, legality, or reliability by us. You are solely responsible for doing your own research before hiring anyone.

2A. Moderation is not verification.

We may remove or unpublish listings, reviews, or accounts at our discretion, for example to address spam, abuse, or violations of these Terms. Doing so does not mean we have reviewed, verified, approved, or endorsed any listing, provider, service, or credential, and the absence of removal does not mean we have done so.

3. No responsibility for interactions or disputes.

Any contact, communication, quote, agreement, payment, or transaction between a customer and a provider is solely between them. We are not a party to it. We are not responsible or liable for: the quality, safety, timing, pricing, or legality of any service; property damage, injury, theft, fraud, or loss; no-shows; non-payment; defective or incomplete work; misrepresentation; or any dispute between customers and providers. We do not mediate, arbitrate, resolve, or refund anything arising from those dealings.

4. Provider responsibility; no protection from disputes.

Providers are solely responsible for their services, advertising claims, pricing, contracts, taxes, employees, subcontractors, licenses, permits, insurance, and compliance with all laws. Providers acknowledge that the Platform does not protect, defend, represent, insure, or indemnify them against any customer complaint, dispute, claim, chargeback, review, or lawsuit, and does not guarantee any leads, customers, jobs, or revenue.

5. Customer assumption of risk and release.

Customers use the Platform and hire providers at their own risk. To the fullest extent permitted by law, customers release us, our owners, members, managers, officers, employees, contractors, and affiliates from any claim, demand, or damages of any kind arising from any dealing with a provider.

6. No warranties.

THE PLATFORM AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AVAILABILITY, AND NON-INFRINGEMENT. We do not warrant that the Platform will be uninterrupted, error-free, or secure.

7. Limitation of liability.

TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE PLATFORM WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE THREE (3) MONTHS BEFORE THE CLAIM AROSE, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

8. Indemnification.

You agree to defend, indemnify, and hold harmless us and our owners, members, managers, officers, employees, and affiliates from any claim, loss, liability, damage, cost, or expense (including attorneys' fees) arising from: your use of the Platform; your listing or content; your services or dealings with any customer or provider; your violation of these Terms or any law; or your violation of any third party's rights.

9. User content and reviews.

Listings, photos, reviews, and messages are created by users. We do not pre-screen or endorse them, and we are not responsible for their accuracy or legality. We may remove content or suspend accounts at any time, at our sole discretion, without refund.

10. No refunds.

All payments are final and non-refundable, as described in our Cancellation & Refund Policy, except where required by law.

10A. Founding Member offer.

The free Founding Member offer ends on March 31, 2027 or when 100 spots are filled. After it ends, Basic is $29/month. You must add a payment method to keep your listing active. Payments are non-refundable.

11. Binding arbitration; class action and jury waiver.

Any dispute, claim, or controversy between you and us arising from these Terms or the Platform will be resolved exclusively by binding individual arbitration administered by [AAA / JAMS] under its rules, in [YOUR COUNTY, STATE], or remotely.

YOU AND WE WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE PROCEEDING. Claims may be brought only in your individual capacity. Either party may bring an individual claim in small-claims court instead, where eligible.

12. Governing law and venue.

These Terms are governed by the laws of the State of [YOUR STATE], without regard to conflict-of-law rules. For any dispute not subject to arbitration, you agree to the exclusive jurisdiction of the state and federal courts located in [YOUR COUNTY, STATE].

13. Time limit for claims.

Any claim against us must be filed within one (1) year after it arose, or it is permanently barred, to the extent permitted by law.

14. Severability; changes; entire agreement.

If any part of these Terms is found unenforceable, the rest remains in effect. We may update these Terms at any time by posting the new version. Continued use means acceptance. These Terms are the entire agreement between you and us regarding the Platform.
